Terms & Conditions
Introduction
These terms and conditions govern the relationship between you and Positive Bakes when you order any products ("Products") listed on our website at www.positivebakes.com ("Website"). These terms set out important information regarding your rights, obligations and restrictions when ordering Products from our Website.
Any reference to "you" or "your" means you as a customer of our Products and/or user of our Website. Any reference to "we", "us", "our" or "Positive Bakes" is to Positive Kitchen & Co Ltd.
Please read these terms carefully before ordering any Products. By ordering our Products, you agree to be legally bound by these terms and conditions.
Please note: We will not file or store a copy of these terms for each transaction. You should save a copy for future reference.
1. Information About Us
We are Positive Kitchen & Co Ltd, a company registered in England and Wales under company number 11693691 with our registered office at Park House, 37 Clarence Street, Leicester, LE1 3RW.
Our site is intended for use by people residing in the UK, including England, Scotland, Wales and Northern Ireland. For international orders, please contact us at hello@positivebakes.com.
2. Your Status
By placing an order through our Website, you confirm that:
- You are legally capable of entering into binding contracts
- You are at least 18 years old
- You are resident in the UK
- You are accessing our site from the UK
3. Our Products
Product Images: Images are for illustrative purposes only. Your Products may vary slightly as natural ingredients vary in colour and size, and devices display colours differently.
Weights & Portions: All weights and portion sizes are approximations unless stated otherwise.
Advice & Instructions: Any advice, recipes or instructions we provide are for general guidance only. We accept no liability for loss, damage or injury arising from following our advice or instructions.
Your Responsibility: You are responsible for inspecting Products upon delivery and storing them correctly. We accept no liability for issues arising from incorrect storage or use.
Allergen Information: If you have allergies, you must check our allergen information before ordering. All Products are produced in a facility that handles nuts. Contact us on 0116 3406599 or hello@positivebakes.com if unsure.
Supply Issues: If we cannot supply a Product (due to delivery date constraints, pricing errors, etc.), we will notify you by email and provide a full refund if payment has been taken.
Supplier Changes: We reserve the right to change suppliers without notification to maintain quality or address supply issues.
4. How Contracts Are Formed
Your order constitutes an offer to buy. We confirm acceptance by sending a Dispatch Confirmation email. The contract is only formed when we send this confirmation. We are not obligated to accept any order.
5. Your Right to Cancel and Return
Perishable Goods: As our Products are perishable, you do not have the standard 14-day return right simply for changing your mind.
Cancellation Before Dispatch: You can cancel orders before receiving Dispatch Confirmation.
Defective Products: If Products are defective or misdescribed, contact us within 24 hours with photographic evidence. We may request safe disposal and will offer exchange or full refund at our discretion.
Refund Timeline: Refunds processed within 14 days via your original payment method.
Minor Issues: For minor defects, we may offer partial refunds or vouchers at our discretion.

6. Delivery
Delivery Days: Tuesday-Friday (8am-6pm), Saturday premium service available (most UK areas, excluding Scottish Highlands).
Order Deadlines:
- Order by 2:30pm Monday-Thursday for next working day delivery
- Order by 12:30pm Friday for Saturday delivery
Address Accuracy: You must provide correct delivery addresses. We cannot accept responsibility for failed deliveries due to incorrect addresses provided.
Safe Place Delivery: We may leave Products in designated safe places at courier discretion. We accept no liability for theft or damage after safe place delivery.
7. Pricing and Payment
Pricing: Prices include VAT and are subject to change, except for orders with confirmed Dispatch Confirmation.
Payment: Payment required before dispatch via credit/debit card using our secure payment processors.
Pricing Errors: We reserve the right to cancel orders with obvious pricing errors, even after Dispatch Confirmation.
8. Discount Codes and Gift Cards
- One discount code per household
- Cannot be exchanged for cash
- Time limits may apply
- We reserve the right to cancel codes or reject suspected fraudulent use
- No liability for lost, stolen or damaged codes
9. Our Liability
We do not limit liability for:
- Death or personal injury from negligence
- Fraud or fraudulent misrepresentation
- Defective products under Consumer Protection Act 1987
- Matters where exclusion would be illegal
Subject to above, our liability is limited to the purchase price of Products and foreseeable losses only.
10. Events Beyond Our Control
We are not liable for delays or failures due to events beyond our reasonable control, including but not limited to: natural disasters, industrial action, transport failures, supplier issues, government restrictions, or telecommunications failures.
11. General Terms
Entire Agreement: These terms constitute the full agreement between us.
Variations: We may update these terms. Changes will apply to future orders unless legally required to apply retrospectively.
Governing Law: These terms are governed by English law and subject to English court jurisdiction.
